Starting September 15, 2026, the United States Citizenship and Immigration Services (USCIS) is rolling out major rule changes for thousands of Indian tech workers, students, and their families living in America. The immigration authority is replacing two of its most critical application forms-Form I-539 (used for extending or changing visa status) and Form I-765 (used to apply for an Employment Authorization Document or work permit). Under strict new guidelines, any application submitted on or after September 15 using older editions will be rejected immediately with zero grace period, meaning applicants cannot afford any paperwork mistakes.

For the common Indian family in the US, knowing which form applies to whom is essential. While primary H-1B employees have their status renewed by employers using Form I-129, their spouses and children on H-4 visas rely on Form I-539 to extend their legal stay. Additionally, eligible H-4 spouses and international F-1 graduates seeking Optional Practical Training (OPT) use Form I-765 to get their official US work authorization cards. USCIS will only accept forms bearing the "Edition 09/15/26" date from September 15 onward.
